Express assumption of risk:

I, the undersigned, am aware that there are significant risks involved in all aspects of martial arts training and other physical activity, including but not limited to classes, sparring, drills, partner work, strength training, and special events conducted on or off premises. The risks include but are not limited to: strains and sprains; blunt force trauma resulting in concussion or contusion which may result in serious bodily injury or death; injuries caused by the negligent acts or omissions of myself or others; and injury or death due to the improper use or failure of equipment.

I am aware that any of these above-mentioned risks may result in serious injury or death to myself or others. I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participating in any activity or class while at, or under the direction of The Lotus Academy LLC.

I, the undersigned, acknowledge that The Lotus Academy LLC recommends that I consult a physician before beginning this or any other exercise program. I, the undersigned, acknowledge that if I develop any pain or abnormal symptoms before, during, or after the above-referenced activities, I should consult a physician. Instruction and advice provided by the instructor is in no way intended as a substitute for medical counseling or treatment.

Release:

In consideration of the above mentioned risks and hazards and in consideration of the fact that I am willingly and voluntarily participating in the activities offered by The Lotus Academy LLC, the undersigned hereby release The Lotus Academy LLC, its principals, agents, employees and volunteers from any liability, claims, demands, actions, or rights of actions which are related to, arise out of, or are in any way connected with my participation in this activity, including those allegedly attributed to the negligent acts or omissions of the mentioned parties, to the fullest extent permitted by law.

This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns or transferees.

If any portion of this agreement is held invalid, I agree the remainder of the agreement shall remain in full legal force and effect.

If I am signing on behalf of a minor child, I also give full permission for any person connected with The Lotus Academy LLC to administer first aid if deemed necessary for the well-being of the child.

Indemnification:

The participant recognizes that there are risks involved in the types of activities offered by The Lotus Academy LLC. Therefore, the participant accepts financial responsibility for an injury that the participant may cause to himself/herself or any other participant due to his/her negligence.

Should The Lotus Academy LLC, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs.

I further agree to indemnify and hold harmless The Lotus Academy LLC, its principals, agents, employees, instructors, independent contractors, and volunteers from any liability for injury, death, or property damage caused by my negligent or intentional acts or omissions during participation in activities conducted by or under the direction of The Lotus Academy LLC, whether occurring on its premises or at off-site locations including but not limited to parks, recreational areas, or other designated training areas.

Photography/Video Release

Participants involved in any activities offered by The Lotus Academy LLC may be photographed or videotaped. The undersigned hereby consents to the use of these photos/videos, without compensation, on The Lotus Academy LLC website, advertising, or promotional material produced or published by The Lotus Academy LLC.

I have read and understand the forgoing assumption of risk, and release of liability and I understand that by signing it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission. I understand that by signing this form I am waiving valuable legal rights.
